Should the Taxman Be Allowed to Trespass On Your Property
The Wisconsin State Assembly is currently considering legislation (Senate Bill 148) that would allow property tax assessors to enter onto your property without being subject to trespass violations. This legislation would give tax assessors more authority to enter onto your property than police officers, who generally must first obtain a search warrant before entering your property. This legislation has already passed the State Senate and is very close to becoming law. Please contact your representative in the State Assembly at 1-800-362-9472 or waml.legis.state.wi.us and tell him or her to oppose Senate Bill 148!
Talking Points:
- The current system provides the necessary checks and balances to ensure that property rights are respected and that property is assessed in a fair and equitable manner.
- Like everyone else, the tax assessor has been required to get permission from the property owner in order to enter onto someone's property.
- If a property owner denies a tax assessor's request, the assessor has the authority to estimate the value of the property along with any improvements. Because the assessor's estimate is presumed to be correct, the property owner has a natural incentive to allow a tax assessor onto the property to obtain an accurate assessment.
- There have been no reported cases finding a tax assessor liable for trespassing.
- SB 148 should be opposed because it:
- Infringes on fundamental rights property owners in Wisconsin have enjoyed for over 150 years.
- Raises privacy concerns upon which private property rights are founded.
- Imposed no limits on access so assessors can enter on to property any day of the week, stay as long as they want and make as many visits as they want.
- Under the bill, assessors have no duty to provide notice to the property owner prior to entry. Property owners receive notice only AFTER an assessor has entered onto their property.
- SB 148 would give assessors greater power than police officers, who generally cannot enter onto private property without a search warrant.

The State Assembly is poised to upset the Democrats in a bold move to break apart the budget. They will move to approve school spending and aids to local municipalities outside of the negotiation process leaving the ball in the Democrats lap. Doyle doesn't like it already. What, won't be able to get all your tax increases when it looks like the Democrats are the bad guys?
Hang tough, Assembly Republicans.

At a recent forum hosted by SAWS, Representative Sondy Pope Roberts repeatedly stated she had a new school funding plan sitting on her desk in Madison 'that would never see the light of day' because of the Republican controlled Assembly. That prompted the Waukesha Taxpayers League to request a copy of the plan. In her response, she states that "Pursuant to State Statute 19.32 (2) the school funding plan referenced at the forum on May 31st isn't not subject to open records request law because it is not an official legislative draft, nor has it been introduced." We have a couple of questions for you Sondy. Do you have a plan or not? and if so, why not share it? We gave you the opportunity to share it publicly and you hide behind legal technicalities yet advocates bullying Republicans to get their school funding solutions and play childish games with other representatives because you didn't get your way. We know and now we can prove that this whole school funding plan is the Democratic Party's way of trying to win the 2008 elections (see 'the bully session for Republicans' above) and it's all about money--just how much you can take away from taxpayers and give to WEAC members.

WEAC doesn't like the Republican version of the budget. It was described as fewer this, fewer that. We see it as protection for the taxpayers and users of government services by directing attention to salaries and benefits that are out of touch with reality. Of course, for more credibility and less spending, the Republicans really should pull out the pork projects.
Neither does the Wisconsin School Administrators Alliance.

The Republican version of the state budget Are they tough enough to do some of this--and yes, there is some creativity involved such as penalizing school districts that offer insurance plans better than the state. Don't know if we agree with everything in here, but have to admit, it will be fun to see if they mean what they wrote.

The biggest budget adder this year is the proposal for Universal Health Care that was added to the budget at the last moment. Representative Mary Lazich swings back. Universal Health Care deserves a healthy debate and not a last minute manuver by the Democratic Party. Another take. & another that addresses the arguments surrounding the Dem's plan.
